WhiteFlutter Yoga Waiver and Release of Liability Agreement
Why You’re Reading This Document The purpose of this Waiver is to communicate the risks of practicing yoga online and have you release WhiteFlutter of all liability. If you are under 18, a legal guardian must also sign on your behalf. By agreeing to this document, you are signing away legal rights. THIS WAIVER INCORPORATES THE POLICIES IN SECTION 11.
1. Parties
"We" refers to WhiteFlutter; "you" refers to the participant. If the participant is under 18 (Age of Majority in Washington State), the signing Parent/Guardian expressly waives their right to sue and agrees to indemnify WhiteFlutter against all claims.
2. The Online Activities
You will participate in virtual yoga and functional movement, including the LYT™ method (the “Activities”). You acknowledge that you are solely responsible for creating a safe practice area in your home and maintaining a stable internet connection.
3. Equipment
You agree to use only the equipment instructed (e.g., blocks, straps, therapy bands) and ensure it is in safe, working condition.
4. Inherent Risks of Virtual Practice
Yoga poses risks of serious injury, including muscle tears, broken bones, or cardiovascular complications. Because there is no in-person supervision, you must use your own judgment; for participants under 18, we recommend that a guardian ensure the practice area is safe before the session begins.
5. Affirmation of Health and Medical Disclaimer
5.1. No Medical Advice. Instruction is for educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment.
5.2. Fitness to Practice. You affirm you have sought medical advice regarding your fitness for yoga. If you are or become pregnant, you affirm you have consulted a physician and will modify your practice accordingly.
5.3. Qualifications. While instruction is based on physical therapy and neuroscience principles, instructors are acting strictly as yoga teachers and do not hold medical certifications in those fields.
6. Voluntary Assumption of Risk
You have read this Waiver and understand the risks. Your participation and electronic agreement show that you’re assuming these risks.
7. RELEASE, WAIVER, AND INDEMNITY
YOU HEREBY RELEASE WHITEFLUTTER FROM ANY AND ALL LIABILITY ARISING FROM PERSONAL INJURY OR DEATH CAUSED BY THE ORDINARY NEGLIGENCE OF WHITEFLUTTER DURING YOUR VIRTUAL PARTICIPATION. YOU AGREE TO FORFEIT ALL FORMS OF LEGAL RECOURSE AVAILABLE TO YOU OR YOUR HEIRS.
8. Media Release
You grant WhiteFlutter the irrevocable right to use your image, video, or audio captured during online sessions for marketing and sales purposes worldwide.
9. Continued Agreement
This Waiver is your continued agreement to all online classes, sessions, or workshops.
10. General Legal Provisions
10.1. Jurisdiction. The laws of the State of Washington govern this Waiver.
10.2. Severability. If any part of this Waiver is found unenforceable, the remaining provisions remain in full effect.
11. Tuition, Cancellation, and Refund Policies
ENERGY EXCHANGE & TUITION
Flexible Enrollment: Participation is offered on a session-by-session basis (Drop-In) or as a recurring commitment (Membership).
Manual Contributions: All tuition must be settled in advance via our secure handles (Venmo: @whiteflutterllc or for Zelle : whiteflutterllc@gmail.com)
No Refunds: To honor the energetic container of the ritual, all exchanges are final and non-refundable.
Consistency of Service: Monthly rates remain constant regardless of the number of weeks in a calendar month.
WITHDRAWAL & RITUAL CANCELLATION
Membership Release: If you wish to conclude your recurring membership, please provide written notice via email (whiteflutterllc@gmail.com) at least 30 days before your next intended billing cycle to ensure your space is released.
Session Credits: You must cancel a scheduled attendance at least 48 hours in advance to retain credit for a future session.
Missed Rituals: We do not offer makeup classes or refunds for missed sessions or technical interruptions on the participant's end.
Final Acknowledgement & Verification
1. Electronic Agreement: By completing the enrollment form on the WhiteFlutter website, checking the ‘I Agree’ box, and providing your electronic signature, you verify that you have read this Waiver, fully understand its contents, and voluntarily agree to all terms above.
2. Minor Consent: If the participant is under 18, the completion of the form by a parent or guardian constitutes formal legal consent on behalf of the minor.
3. Confirmation of Exchange: You verify that you have submitted your tuition for the selected ritual (Drop-In or Membership) using the WhiteFlutter secure handles (Venmo: @whiteflutterllc or for Zelle: whiteflutterllc@gmail.com)
4. Sanctuary Access: You understand that your enrollment is finalized and the Zoom sanctuary link will be released only after both this waiver and your payment have been verified by the WhiteFlutter team.
